All trademarks, service marks, and trade names are proprietary to Speed Culture. All other trademarks not owned by Speed Culture that appear on this site are the property of their respective owners, who may or may not be affiliated with, or connected to Speed Culture. Any unauthorized use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. All software used on this site is the property of Speed Culture or its software suppliers and is protected by international copyright laws and may not be reproduced, modified, distributed, transmitted, or republished.
Order Acceptance and Submissions
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The contract between us only becomes binding when we confirm our acceptance of your order.
Speed Culture reserves the right at any time after receipt of your order to accept or decline your order for any reason. Speed Culture reserves the right at any time after receipt of your order, without prior notice to you, to supply an alternate product of equal quality or less than the quantity you ordered of any item and adjust your invoice accordingly. In the event that any such items are deemed unacceptable by the customer they may be returned to Speed Culture which will pay for their return carriage.
Speed Culture may require additional verifications or information before accepting any order. International orders may be subject to additional transport costs, tariffs, taxes, and regulations. Speed Culture is not responsible for shipping delays or any additional fees for international orders.
All customers must pre-pay for all products. We will accept personal cheques, banker’s drafts and credit cards. All dispatches where payment method is by personal/company cheque must wait two weeks for clearance.
Warranty, Limit of Liability and Disclaimer
The Speed Culture web site (http://www.speedculture.co.uk) and the materials therein are provided as shown. You agree that Speed Culture, its directors, officers, employees or other representatives shall not be liable for damages arising from the operation, content or use of the Speed Culture web site. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.
Speed Culture does not offer warranty on any of the products sold. This does not affect your statutory rights. All products sold by Speed Culture are aftermarket products. Removal of reinforcements, bumpers and other safety equipment on the vehicle is the responsibility of the buyer. Speed Culture will not be responsible for the Buyer’s own actions or instructions.
If any work carried out by Speed Culture is found to be defective, such defects are to be reported by the Buyer as soon as possible following delivery. Speed Culture will be under no liability in respect of alleged defects unless the Buyer gives written notice of the defects as soon as is practicable and grants adequate opportunity for Speed Culture or its representative to further inspect the work. Speed Culture may, at their discretion, either rectify the work or credit the Buyer with a corresponding proportion of the original cost but shall not be under any other liability in respect of work carried out or any third party costs unless specifically agreed by Speed Culture.
Speed Culture shall have the right to refuse or cancel any orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Speed Culture shall immediately issue a credit to your credit card account in the amount of the incorrect charge.
Shipping and Handling Policy
All our packages are delivered by insured carrier. It is the customer’s responsibility to check all packages on delivery if possible or as soon as possible thereafter as some products may have been damaged during transit.
We ask that you do not sign the delivery receipt as being "received in good condition" if you have not examined the goods. If in any doubt sign the receipt as ‘package not examined at time of delivery’.
The buyer must examine the Goods at the earliest opportunity and in the event that damage has occurred preferably note the specific damage on the delivery note and have the delivery person sign it as verification or, if this was not possible on delivery, examine the goods as soon as possible after delivery.
When damaged goods are received contact Speed Culture as soon as the damage has been identified to file a claim request. Unless notice of any loss or damage of goods in transit is given by the Buyer and received by Speed Culture within a reasonable time of either their expected delivery or their delivery the Buyer shall be deemed to have accepted the goods and the Seller shall be relieved and discharged from all liability in respect thereof. The Sellers liability in the case of loss or damage in transit shall be limited to repairing or replacing the Goods or allowing the Seller to cancel the order and receive a full refund and the Seller shall not be under any other liability whatsoever, including indirect or consequential loss and loss of profit.
Please return goods in or with the original packaging materials.
Where goods are not shown as "Stock" or with a specific delivery time, e.g. 2/3 days, they may need to be specially ordered. In such instances the time for delivery shall not be of the essence of the contract. However Speed Culture will endeavour to deliver within 30 days of receiving your order. If this is not possible we will notify the Buyer and allow them to either cancel or continue with the order at their discretion. If the Buyer decides to continue with the order Speed Culture will update them regularly.
Speed Culture shall not be liable for any loss or damage whether arising directly or indirectly from delay in delivery.
Delivery of the Goods shall take place:-
• when they are loaded off the vehicle or other transport at the address specified by the Buyer
• where the Buyer undertakes to collect the goods, when they are loaded on the Buyers vehicle or transport.
Under the Consumer Protection (Distance Selling) Regulations 2000 consumers have the right to cancel their order within 7 working days of receiving the goods and returning them to Speed Culture. Under the Regulations products can be returned for a full refund, exchange or credit note subject to the following conditions:
• that any proposed returns must be notified to us within 7 working days after the goods have been received and must be returned in an unused and unaltered condition, preferably with the original packaging (or better)
• that you are a Consumer and not acting in the course of a trade or business
• that the cost of the return carriage is paid by you, the consumer, otherwise Speed Culture reserve the right to charge you for the return of the items.
Where consumers are exercising their right to cancel a contract within 7 days of receiving the goods we will refund all sums due as soon as possible after the consumer cancels, and within a maximum of 30 days.
Notice of your intention to cancel should be sent via email to email@example.com or by post to Speed Culture, Alders Way, Yalberton Industrial Estate, Paignton, Devon TQ4 7QL. Once the return of the goods has been agreed the consumer must return the goods, at their own expense, to the above address.
Any alteration you may have made to the products which means that they cannot be restored to their original condition will invalidate your cancellation rights. Similarly any goods made to a customers’ specification cannot be returned. This does not affect your statutory rights.
Any products ordered by a business or a person acting on behalf of a business, or any person who has previously inspected the goods at a show or our premises do not fall within the provisions of the Distance Selling Regulations and cannot be returned unless by prior agreement. This does not affect your statutory rights.
If you are retuning a product due to poor fitment or damage then we will require photographic evidence to support your claim. Failure to supply such evidence may result in your return being refused.
Any products not returned in accordance with these conditions may only be returned by agreement and may also be subject to a 25% handling charge and the initial cost of transport.
In the event a product is listed at an incorrect price or with incorrect information, Speed Culture shall have the right to refuse or cancel any orders placed for products listed at the incorrect price whether or not the order has been confirmed and your credit card charged.
If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.
These Conditions (as amended from time to time) contain the entire agreement between you and Speed Culture relating to the subject matter covered and supersede any previous agreements, arrangements, undertakings or proposals, written or oral, between you and us in relation to such matters.
You agree that any legal action brought against Speed Culture shall be governed by English law. You agree that the sole jurisdiction and venue for any litigation arising from your use of our site or the products contained therein shall be an appropriate English Court.
